Rule 12(b)(6) Motion to Dismiss Granted.
Electronic Horse Racing Game.
The Court granted the motion to dismiss on the grounds that the patents were directed at allowing people to watch and gamble on various forms of animal racing. In particular, the patents covered “computer-aided gambling, including wagering on past events.” The patents' usage of computers and internet communications to facilitate this gambling did not create patentable invention. It was nothing more than the utilization of generic computer equipment to facilitate the long standing gambling practices.
